The owner of the online store www.chocokoo.ee (hereinafter referred to as the online store) is CHOCOKOO OÜ, (reg.code 12851789), legal address Põdra 30, 10915 Tallinn.
Validity of contract of sale, product and price information
The conditions of sale apply to purchases of goods from the online store.
The prices of the products sold in the online store are indicated next to the products. A fee for shipping is added to the price.
The shipping cost depends on the location of the purchaser and the shipping method. The shipping cost is displayed when the purchaser places the order.
Product information is provided immediately adjacent to the product in the online store.
Placing an order
There are three categories in the online store to choose the products:
1) Assorted boxes – Selection made by the chocolatier in boxes of different sizes. If you wish the chocolatier to make the chocolate selection for you, choose the size of the box suitable for you, click Add to Cart button and then Check the Cart button. Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid via an online bank link.
2) Pick and mix – In this category you can pick and mix the desired bonbons-truffles into the box of suitable size. At first choose the size of the box (box of 4, 6, 10, 16), then photo gallery of bonbons-truffles opens where you can make your selection. Clicking on the product photo the short description and allergy information of the bonbon-truffle opens. To select click +- button under the photo of the bonbon-truffle and you can see the number of selected items. If you have selected less or more than suitable for the box red alert message will appear. When the bonbons-truffles are selected click Add to Cart button, you can see your selection under Check the Cart. The selected products are in the cart, you can still make the changes updating the cart. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid via an online bank link.
3) Chocolate bars – In this category you can choose the bean-to-bar chocolate bars according to origin. Clicking on product photo short description is displayed. Add the desired products to your shopping cart and click Check the Cart. The selected products are in the cart, you can still make the changes updating the cart. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid via an online bank link.
The contract enters into force when the amount payable is transferred to the bank account of the online store.
If we cannot deliver the ordered goods due to stock running out or for any other reason, the purchaser will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification.
Payment methods
In online store you can pay for the products in euros (€) via indicated bank links, Estonian, Latvian, Lithuanian and Finnish bank links, Visa MasterCard card payments. After payment exit the internet back page by clicking “Back to the Merchant” button. Confirmation of the order is displayed on the screen. Chocokoo OÜ is the data controller, Chocokoo OÜ forwards the personal data necessary to complete the payment to the authorised processor Montonio Finance UAB, registry code 305205122, address Konstitucijos 7, Vilnius, Lithuania.
Shipment
Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland.
Orders are posted to the parcel terminals of Omniva and Itella Smartpost. In addition the customer can pick up the order from Chocokoo shop Telliskivi 60a/5, 10412 Tallinn.
The purchaser bears the shipping cost and the respective price information is displayed next to the shipping method. All shipments within Estonia generally arrive at the destination specified by the purchaser within 1-3 business days of the date of entry into force of the contract of sale. All shipments outside of Estonia are guaranteed to arrive within 3-7 calendar days.
Right of withdrawal
According to the Law of Obligations Act § 53 (4) the right of withdrawal does not apply to the products that have been shipped and delivered in closed packages and that are not valid for withdrawal due to health protection or hygienic reasons if the package has been opened after delivery.
Complaints
The online store is responsible for the non-compliance of goods sold to a purchaser with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the purchaser. Within the first six months of delivery it is assumed that the defect was present at the time of delivery. It is the online store ́s responsibility to prove otherwise.
The purchaser has the right to turn to the online store within two months of the occurrence of a defect by e-mailing info@chocokoo.ee or calling +372 5028466. The online store is not liable for any defects arising after delivering the goods to the purchaser. If goods bought from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store shall return to the purchaser all of the payments involved in the contract of sale. The online store will respond to the consumer ́s complaint in written form or in a form that enables written reproduction within 15 days.
Settlements of disputes
All complaints made by a purchaser about the online store must be e-mailed to info@chocokoo.ee or submitted by calling +372 5028466.
If the purchaser and the online store are not able to settle the dispute by agreement, the purchaser may contact the Consumer Dispute Committee. You can review the procedural rules and submit a complaint here. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the online store. Resolution of disputes by the Consumer Dispute Committee is free of charge for the purchaser.
A purchaser may also turn to the dispute resolution bodies of the European Union.
